Terms and Conditions

Accepting These Terms

This document, our rules, policies and the other documents referenced make up our Terms and conditions (“Terms”). The Terms are a legally binding contract between you and DCP Accounting. Please read them carefully.

(e) You will treat the application and its users with respect and will not partake in any conduct that could be considered bullying, harassment, degradation, insulting or otherwise demeaning to the human standard of any other person (as determined by us).

Registration And Password​

You are responsible for:


(a) Maintaining the confidentiality of your registration and personal information, password and other confidential information relating to your use of your account;
(b) All uses of your registration, whether or not authorized by you.
(c) Maintaining all equipment required for your access to and use of the account.
(d) All charges resulting from your account, including unauthorized use prior to you notifying Protax Canada Inc. of such use and taking steps to prevent its further occurrence by changing your password; and
(e) Notifying Protax Canada Inc. immediately of any unauthorized use of your registration or password.

User Representations​

You represent and warrant that you are at least 18 years old and that you possess the legal right and ability to agree to be bound by these Terms & Conditions and to use the services in accordance with these Terms & Conditions.


You expressly acknowledge and agree that you are currently and will continue to be, financially responsible for your use of the services including use of your account by others (including but not limited to children who are residing with you) and will comply with your responsibilities and obligations as stated in these Terms & Conditions.

Disclaimer And Limitation Of Liability​

You expressly agree that use of the services is at your sole risk. The services are provided on an "as is" and "as available" basis.
DCP Accounting recommends that you seek independent advice before acting upon Content on the account or Third Party Material.


In no event will DCP Accounting be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the application or any materials or content available through the application, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not DCP Accounting has been informed of the possibility of damage.

Copyright Infringement​

DCP Accounting is committed to complying with copyright and related laws and requires all application visitors and users to comply with these laws. Accordingly, you may not use the application to store any material or content, or disseminate any material or content, in any manner that constitutes an infringement of third party intellectual property rights.

  • Are defamatory, illegal, profane, vulgar, threatening, unlawfully discriminatory, illegal, pornographic, obscene, or sexually explicit in nature,

  • Would violate the intellectual property rights, such as and including copyrights, of another person, entity, service, product, or application,

  • Are harassing toward another person based on the person's inclusion in a protected class as defined by applicable law.

Intellectual Property Rights​

DCP Accounting and our licensors retain all right, title, and interest in and to all Intellectual Property Rights related in and to the application and the application services. DCP Accounting logos and names are trademarks of DCP Accounting and are registered. All other product names, company names, marks, logos, and symbols on the application or application services may be the trademarks of their respective owners.

Third Party Trademark Rights​

The terms and conditions apply to your use of the Service and you consent to the collection and use of your information, including personally identifiable information by DCP Accounting. Our Service may contain links to third-party applications or services that we don’t own or control that enables you to export information to third party services. You may also need to use a third party’s service to use some features of our Service or use through our implementation of third party buttons. When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own Terms & conditions and privacy policies. DCP Accounting is not a party to those agreements; they are solely between you and the third party.

(ii) your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation;

(iii) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or

(iv) any dispute or issue between you and any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of that claim.

Waiver​

No waiver of any provision hereof shall be effective unless made in writing and signed by the waiving party. The failure of any party to require the performance of any term or obligation of this Agreement, or the waiver by any party of any breach of this Agreement, shall not prevent any subsequent enforcement of such term or obligation or be deemed a waiver of any subsequent breach.

Agreement​

This Agreement contains the entire agreement and understanding among the parties hereto with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to the subject matter hereof. The express terms hereof control and supersede any course of performance and/or usage of the trade inconsistent with any of the terms hereof.
